An application for a use permit will not be accepted or processed for a conditional condominium use permit if the vacancy rate for multifamily rental apartments in the Lower Ross Valley is below five (5) percent. The rental vacancy rate shall be determined on an as-needed basis, when an application for a condominium conversion is submitted, pursuant to procedures approved by the Planning Commission.
