A. All units of a multi-unit residence for which a certificate of occupancy was issued after May 20, 2011, or was let for residential use for the first time after May 20, 2011, are designated nonsmoking units.

B. As of September 17, 2022, all units of a multi-unit residence for which a certificate of occupancy was issued before May 20, 2011, or was let for residential use for the first time before May 20, 2011, are hereby designated nonsmoking units.

C. Smoking in a designated nonsmoking unit is a violation of this chapter.

D. At least one hundred twenty (120) days before September 17, 2022, the landlord of a multi-unit residence described in subsection (B) of this section shall provide each tenant with:

1. A written notice clearly stating that all units, including the tenant’s unit, are designated nonsmoking units and that smoking in a unit will be illegal as of September 17, 2022; and
