The fees paid pursuant to the provisions of this chapter shall be set aside by the City in a special revenue fund in a manner to record the fees separate from other revenues or funds of the City, and record any expenditures for the purpose of constructing or providing only the programmed transportation system improvements listed in the resolution adopted pursuant to Larkspur Municipal Code Section 18.15.050(B). Any interest income earned on the fund shall also be deposited therein and shall only be expended for the purposes set forth in this section. The City Council shall review annually fund balances, projected revenues and required transportation improvements and make a determination for use of the funds as a part of the Capital Improvement Plan and Annual Budget, or the refunding of all or a portion thereof, as may be required by state and local law.
